"About one in every five people in the United States has a disability. Some people are born with a disability. Some get sick or have an accident that results in a disability. Some people develop disabilities as they age. Almost all of us will have a disability at some point." – Surgeon General
The National Academy of Elder Law Attorneys (NAELA) established October as National Special Needs Law Month to assist those with disabilities and their families to better understand special needs planning and the resources that are available to them.
Benzinga published a press release, titled “NAELA Celebrates National Special Needs Law Month in October,” which discusses special needs planning.
Special needs planning frequently will involve special needs trusts, care management, advocacy to preserve educational or civil rights, public benefits such as Supplemental Security Income (SSI) and Medicaid, along with a variety of other important issues.
Special Needs Law is a specialized practice of law that involves representing, counseling, and assisting people with disabilities and their families. This involves a number of legal issues, such as disability planning and mental health. These attorneys focus on promoting the highest quality of life for the individuals impacted. Special Needs Law attorneys usually look at their clients’ situation from a holistic viewpoint and discuss legal, medical, financial, social, and family issues.
In October, NAELA member attorneys will focus on helping those with special needs by identifying resources and implementing comprehensive plans. Many NAELA members will be celebrating National Special Needs Law Month with activities in their communities. They’ll be covering areas such as the following:
- Financing long-term care;
- Care management;
- Durable powers of attorney;
- Guardianship and conservatorship;
- Planning for health care decision-making;
- Special needs trusts; and
- Social Security Income rules.
